Immediate Termination of Agreement:
If the Renter breaches any terms or conditions of this agreement, including but not limited to:
- Failure to return the vehicle on time,
- Non-payment or delayed payment of fees or damages,
- Misuse or unauthorized use of the vehicle,
- Providing false or misleading information during the rental process, or
- Causing damage to the vehicle due to negligence, recklessness, or intentional acts,
- Public Rental Zone reserves the right to immediately terminate the rental agreement without prior notice.
3.2 Permanent Ban from Public Rental Zone Services:
Upon breach of the agreement, the Renter will be permanently banned from renting vehicles from the Public Rental Zone or any affiliated businesses, under all circumstances.
3.3 Additional Reporting:
Public Rental Zone reserves the right to report the breach to:
- Car rental industry databases and platforms, make the Renter ineligible to rent vehicles from other service providers.
- Local authorities or private registries for tracking rental violations.
- Credit bureaus, which may impact the Renter’s credit score and ability to secure credit-based services in the future.
3.4 Financial Penalties:
The Renter agrees to pay the following in the event of a breach:
- A breach penalty of $500 for administrative costs and loss of revenue.
- Double the daily rental fee for every day the vehicle remains unreturned past the agreed return date.
- Full reimbursement for damages caused to the vehicle, including towing and recovery costs.
3.5 Personal Guarantor Liability:
If the Renter provided a guarantor for the rental, the guarantor will be held financially liable for any outstanding amounts owed to the Public Rental Zone, including breach penalties, damages, or other charges.
3.6 Security Blacklisting:
Public Rental Zone will retain the Renter’s personal information, including government-issued ID and payment details, to prevent future unauthorized attempts to engage Public Rental Zone services.
3.7 Recovery of Vehicles:
In cases of failure to return the vehicle, the Public Rental Zone is authorized to reclaim the vehicle without prior notice. Any costs related to this process, including towing, legal, and recovery fees, will be charged to the Renter.
3.8 Future Travel Ban:
Public Rental Zone may collaborate with international travel and car rental associations to restrict the Renter from accessing rental services worldwide.
3.9 Legal Enforceability and Liability:
This section is governed by the applicable laws of Surrey, BC. Public Rental Zone reserves the right to pursue legal action for any losses arising from a breach, and any disputes will be resolved under the exclusive jurisdiction of the courts in Surrey, BC.
3.10 Reporting to Credit Bureaus:
Public Rental Zone reserves the right to report unpaid balances, breaches of contract, or any financial penalties associated with the Renter’s account to licensed credit bureaus. Such reports may negatively affect the Renter’s credit score and ability to access credit services in the future.
3.11 No Appeals:
The Renter acknowledges and agrees that all actions taken by the Public Rental Zone under this section, including termination, penalties, reporting, and bans, are final and not subject to appeal or negotiation.
